Can Tourists Buy Cannabis in Orlando? Here's What's Actually Legal

This one confuses a lot of visitors, so let's be precise. Recreational marijuana is not sold to tourists in Florida — but there is legal, hemp-derived THC you can buy without a card. Here's the real picture.

Updated July 2026 · iSmokee Orlando & Kissimmee

Recreational marijuana: not for tourists

Let's clear this up first: Florida does not have recreational (adult-use) marijuana sales. There are no walk-in weed dispensaries for tourists. Marijuana is legal in Florida only for medical patients who hold a Florida Medical Marijuana card, which requires state residency documentation and a qualifying condition — not something a visitor can get for a weekend trip.

So if you're picturing a Colorado- or California-style dispensary, that doesn't exist here for visitors. Anyone telling tourists otherwise is misleading you.

What IS legal: hemp-derived THC

Here's the part most visitors don't know. Under the federal 2018 Farm Bill and Florida law, hemp-derived THC products are legal to sell to adults 21+ without any medical card. These are different from marijuana — they're made from hemp — but they do contain real THC and can be psychoactive. Common types you'll see in smoke shops:

This is the category smoke shops like iSmokee carry. For edibles specifically, see our THC gummies guide.

Buying it responsibly as a visitor

This article is general information for visitors, not legal or medical advice. Hemp and THC laws can change — check current Florida and federal rules. THC products are for adults 21+, contain THC, have not been evaluated by the FDA, and are not intended to diagnose, treat, cure or prevent any disease. Never drive while impaired.

FAQ

Can tourists buy weed in Orlando?

Not recreational marijuana — Florida has no adult-use dispensaries, and medical marijuana requires a Florida card that visitors generally can't get. However, hemp-derived THC products (Delta-8, THC-A, hemp Delta-9) are legal to buy at smoke shops for adults 21+.

Is there a dispensary near Disney for tourists?

Florida dispensaries are medical-only and require a state medical marijuana card, so they're not an option for most visitors. Hemp-derived THC at smoke shops is the legal route for tourists 21+.

Is Delta-8 legal in Florida?

Hemp-derived Delta-8 and similar products are sold legally to adults 21+ in Florida under current law. Laws can change, so buy from an established, lab-testing shop.
