These Terms of Service ("Terms") govern your use of the website at ismokee.com (the "Site"), operated by iSmokee ("iSmokee," "we," "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

You must be 21 years of age or older to use this Site or to purchase any product from iSmokee. A valid government-issued photo ID is required for all in-store purchases, without exception.

1. Age & eligibility

By using the Site, you represent that you are at least 21 years old. iSmokee sells age-restricted products and reserves the right to refuse service to anyone who cannot present valid proof of age.

2. Informational use of the Site

The Site is provided for general information about our stores, hours, locations, and the categories of products we carry. It is not a store: we do not sell products, take orders, or process payments online. All purchases are made in person at our Orlando or Kissimmee locations.

3. Products, availability & pricing

Product descriptions, brands, and imagery on the Site are for general reference. In-store availability, selection, and pricing change frequently and are not guaranteed by anything shown on the Site. Call ahead if you want to confirm a specific item is in stock.

4. Regulated products & no medical claims

iSmokee sells age-restricted products that may include nicotine and tobacco items, hemp-derived CBD and Delta products, kratom, hookah and related accessories. Where legally sold, these products:

Are intended for adults 21+ only and are used at your own risk;
Have not been evaluated by the U.S. Food and Drug Administration, and are not intended to diagnose, treat, cure, or prevent any disease;
Contain nicotine where applicable, which is an addictive chemical; and
Are your responsibility to purchase and use in compliance with all applicable federal, state, and local laws.

5. Acceptable use

You agree not to use the Site unlawfully, attempt to disrupt or gain unauthorized access to it, or misuse the contact channels we provide (for example, by sending spam).

6. Intellectual property

The Site's design, text, logos, and graphics are owned by iSmokee or its licensors and may not be copied or reused without permission. Third-party brand names and product images belong to their respective owners and are shown for identification only.

7. Third-party links

The Site links to third-party services such as Google Maps and Google Business Profile. We are not responsible for the content, policies, or availability of external sites.

8. Disclaimer of warranties

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, availability, or fitness for a particular purpose. We do not guarantee the Site will be error-free or uninterrupted.

9. Limitation of liability

To the fullest extent permitted by law, iSmokee is not liable for any indirect, incidental, or consequential damages arising from your use of the Site or reliance on its content.

10. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Orange County, Florida.

11. Changes to these Terms

We may update these Terms at any time. Changes take effect when posted, and the "Last updated" date will change. Your continued use of the Site means you accept the updated Terms.
