Kratom Laws in Florida
Kratom is legal in most of Florida, with a couple of important specifics. Here’s the plain version — not legal advice.
The short answer
Kratom is legal to buy and possess for adults in Florida statewide, with one well-known local exception (Sarasota County) and a state consumer-protection law that sets rules for how it is sold. It is 21+ to purchase.
The Florida Kratom Consumer Protection Act
Florida passed a Kratom Consumer Protection Act that regulates the sale of kratom rather than banning it. In broad terms, these laws set a 21+ minimum age and put rules on labeling and on adulterated or contaminated product. The practical effect for you: buy from a shop that sells properly labeled product and cards for age.
The Sarasota County exception
Sarasota County has its own local ban on kratom that predates the state law and remains the notable exception. Elsewhere in Florida — including the Orlando and Kissimmee area — it is legal for adults 21+. If you travel around the state, be aware the local rule can differ.
Buying it the right way
- You must be 21+ with valid ID.
- Choose labeled, tested product from a reputable shop — see kratom forms for what to expect.
- Know that other states and countries regulate or ban kratom differently — don’t assume you can travel with it.
The honest caveat
Kratom regulation is an active area and can change at the state and local level. This page is a general overview, current to 2026, not legal advice — check the current rules for your specific location if it matters. And separately from legality: kratom is not FDA-approved, carries real risks, and should be approached carefully — see dosage and effects.
