Where You Can Actually Smoke or Vape Around Orlando

Nobody tells you this at check-in, and the answer changes depending on whether you're in a hotel room, a theme park, a rideshare or a parking lot. Here's the real map — including the hotel fee that catches people out.

Start with the state law

Florida's Clean Indoor Air Act bans smoking in enclosed indoor workplaces. In 2018 voters passed a constitutional amendment that added vaping to the same ban, effective July 2019.

So the default across the state is simple: indoors, in any business, the answer is no — and that includes vaping, which a lot of visitors assume is treated differently. It isn't.

There are narrow exceptions — stand-alone bars, retail tobacco shops, designated hotel smoking rooms where they still exist — but those are exceptions, not the rule. Assume no, and look for a posted sign saying otherwise.

Hotels and resorts: the expensive mistake

This is where visitors lose real money. Nearly every hotel in the Orlando tourist corridor is 100% smoke-free indoors, and that covers the room, the balcony at many properties, and the hallways. Most treat vaping identically to smoking.

Break it and you're not getting a warning — you're getting a cleaning or remediation fee billed to the card on file, commonly in the hundreds of dollars. Vapor is easier to hide than smoke, but rooms have detectors, housekeeping notices, and the charge usually lands after checkout when arguing about it is hardest.

Two minutes that save you a few hundred dollars: ask at check-in where the designated outdoor smoking area is. Every large property has one. Ask where it is rather than guessing, because "outside" and "the designated area" aren't always the same place, and balconies are frequently off-limits.

Disney: outside the gates only

Disney removed smoking areas from inside its theme parks in 2019. Designated areas are now outside the park entrances, and vaping is treated the same as smoking.

In practice that means exiting the park, walking to the area near the entrance, and coming back through bag check and security. Plan it around a meal or a break rather than mid-afternoon in a 40-minute queue.

Universal, SeaWorld and the rest

Universal Orlando has historically kept designated smoking areas inside its parks and CityWalk, which is a meaningful difference from Disney if you're choosing where to spend a day. Locations move as areas get rebuilt, so grab a map at the gate or ask a team member rather than relying on last year's blog post.

SeaWorld and the smaller attractions generally follow the same pattern: designated outdoor areas, nothing indoors. The reliable move anywhere is to ask at guest services on the way in.

Beaches, parks and public spaces

A 2022 Florida law gave counties and cities the power to ban smoking at their own public beaches and parks, and many have used it. That's why the rule can genuinely change between one beach and the next twenty minutes down the coast.

There's a quirk worth knowing: the law as written carved out unfiltered cigars, so some local bans apply to cigarettes and vapes but not cigars. Don't rely on that — read the posted signs, which are the thing that actually gets enforced.

Cars, rideshares and parking lots

Your own rental car is your business, though nearly every rental company charges a smoking cleaning fee if they detect it on return, and that includes vapor residue.

In an Uber or Lyft, the answer is flatly no — it's against both platforms' rules, and drivers can charge a cleaning fee and report you. Ask before you light or vape anything, including in a stopped car.

Hotel parking garages and outdoor lots are usually the most practical spot, provided you're away from entrances. Florida generally requires distance from doorways and air intakes, and hotels post their own limits.

Ask where the designated area is when you check in, and the entire issue disappears for the rest of your trip.

Can you smoke or vape in your Orlando hotel room?

Almost never. The vast majority of Orlando hotels and Disney and Universal resorts are 100% smoke-free indoors, and most treat vaping the same as smoking. Smoking in a non-smoking room typically triggers a cleaning fee that can run into the hundreds of dollars. Use the designated outdoor areas instead.

Can you vape at Disney World?
